This class and collective action lawsuit was filed on behalf of Harry & David call center hourly employees who have worked for Harry & David at its Medford, Oregon call center. The lawsuit alleges that Harry & David has violated the federal Fair Labor Standard Act and Oregon state law by failing to pay for all the time worked by its call center workers, and for failing to provide its call centers with a full thirty-minute meal break.
If you worked for Harry & David as an hourly call center employee at its Medford, Oregon call center at any time since March 8th, 2012, you are a Class Member (Plaintiff) in this lawsuit.

This class action lawsuit was filed on behalf of call center workers alleging that Harry & David violated the federal Fair Labor Standards Act and Oregon state law by failing to pay them for all hours worked and by failing to provide them with a thirty-minute meal break. Specifically, the Plaintiff class members in this case allege that Harry & David failed to pay them at the beginning of their shift, during their unpaid meal break, and at the end of their unpaid meal break. Plaintiff class members seek to recover wages for their entire meal break time periods, because they allege that they were not provided full thirty-minute meal breaks that they allege are required under Oregon law. Finally, Plaintiff class members seek the recovery of penalties provided for under Oregon law for Harry & David’s alleged failure to pay them in accordance with the law.
